Terms of delivery

We ship orders within 4 to 8 business days once shipped, your order should arrive within the following deadlines

- Express Delivery in France / Delivery time 4 to 7 days with DPD

- Express Delivery in Europe / Delivery time 5 to 8 days with DPD (delivery against signature only) Free delivery excluding "ISLANDS" (for beds and sofas).

We do our best to keep all items in stock.
However, some items sell faster than expected and may experience production delays. If an item is out of stock, we will inform you.

Damaged/stolen/lost package

- MX home declines any responsibility in case of excessive delivery delays due to postal services. The customer is required to check the condition of the packaging and items upon delivery. It is the Customer's responsibility to make any reservations and claims deemed necessary, or even to refuse the package, when it is clearly damaged upon delivery. We advise you to systematically check the contents of the package in the presence of the carrier, to check the condition of the items, even if your package shows no signs of damage.

- If according to our tracking your packages are shown as "delivered" with proof of delivery and signature: You must contact DPD and provide the requested information for the search of your package.

- If the package is returned to us for the following reasons: prolonged absence, error in the delivery address, prolonged absence at a pick-up point: MXHOME will not cover the shipping costs for the re-delivery of your order.

Deliveries outside of Europe are subject to customs duties and/or taxes.

If you are ordering from outside Europe (Switzerland), taxes and customs fees will be calculated automatically during checkout to ensure fast and trouble-free delivery.

Refund policy

You must contact customer service within 24 hours of receiving the package by informing us via email of the reason for your return or exchange. The item must be returned to us with its original packaging and in its original condition within 14 days.

Not included:
- Custom-made items
- Sale items

Any custom-made or personalized product cannot be refunded or exchanged, and any request for exchange or refund from December 23 onwards will not be considered for the Christmas collection. The company reserves the right to refuse any refund or return under certain conditions.

Each package undergoes a thorough inspection; incomplete, damaged, used, or soiled returned items will not be refunded. If everything is in order, your refund will be automatically re-credited to the same payment method used within 6 days.

For France: One prepaid shipping label will be sent to you by email.
For Europe + international:  Return shipping costs are your responsibility.
*For Foam Beds, Sofas, and 150 cm Pine : Return shipping costs are your responsibility for France, Europe, and International.

Guarantee

The warranty does not cover repairs and replacements caused by normal wear and tear or by a lack of regular inspection or maintenance of the product, by negligent, inappropriate, or incorrect use, or by use not in accordance with the usual provisions or rules indicated in the product's technical sheet. Furthermore, the warranty does not cover maintenance work or repairs carried out by unauthorized third parties, nor the use of damaged or non-original spare parts.

- The warranty does not apply if the damage results from misuse, punctures, scratches on objects unrelated to the fabric's function, accidents, negligence, vandalism, or extreme natural phenomena. It also does not cover the settling of beads that may occur with use over time.

- Normal wear and color fading, stains caused by environmental pollution or other extreme external factors are not covered by the warranty. When the warranty applies, it is limited to the repair of the product. The warranty starts from the date of the invoice.

Our after-sales service / warranty conditions require a report within 14 days of receiving the product. After this date, shipping costs (round trip) for repair are the responsibility of the customer.

Privacy policy

We offer secure 3D online payment transactions. We accept payment by debit or credit card: Visa, MasterCard, American Express, Apple Pay and Paypal. For direct bank transfers, please contact us.

Your privacy is important to us. mx-home.com is committed to protecting your privacy. We will not sell or disclose any
information without your prior authorization.

All elements created by MXHOME on the site, Facebook groups and content on social networks and platforms are protected by French copyright law as original works. The absence of a registered copyright symbol does not mean that these materials are not protected.

The MX Home creations and brand are registered and protected by French law and copyright.

Care of cushions/ottomans

Precautions for use Do not place your beanbag near a fireplace or central heating. Our beanbags and cushions are neither toys nor buoys. Styrofoam beads are dangerous to children if swallowed or inhaled. The use of MX HOME beanbags and cushions is not recommended for those under 18 years of age.

1) Beanbag XL exterior:

Wipe a damp cloth with a little soapy liquid. If the stain persists, remove the cover from the pouf and put the cover in the machine at 30 (air drying only). It is advisable to overwinter it. XL beanbags must be taken out of the water after each use so that they can dry. It is also strongly recommended to rinse them with clean water after each use. If the XL beanbag is not in use, it is important to keep it dry and under a protective cover. n. 

2) Outdoor cushion:

3) Velvet interior cushion:

All our cushions and poufs which does not have an interior pocket have a child safety zipper. To open your ottoman or cushion you will need a paper clip, place the paper clip at the top of the zipper slider and use it to pull the slider up or down on the zipper. SEE PHOTO EXAMPLE HERE

If the beanbags or cushions are within reach of children, it is important to remember to remove the paper clip from the zipper hole when you are finished.

Terms of sales

Preamble
These general terms and conditions of sale (hereinafter referred to as the "Terms") are entered into between:

On the one hand, MXHOME, a company with a capital of 1000 euros, registered with the Frejus Trade and Companies Register under number 918620477, intra-community VAT FR69918620477, and headquartered at 980 avenue du Peyrat 83310 Grimaud, France (hereinafter referred to as "MXHOME", "we" or "our"), 

and on the other hand, the individuals, consumers (hereinafter referred to as the "Client(s)" or "you/your"), wishing to make a purchase via the online sales site: m-x-home.com MXHOME and the Clients are together hereinafter referred to as the "Parties."

Subject
These Terms aim to define the sales conditions between MXHOME and its Customers, from order to delivery. Any differences based on the Customer's status, whether consumer or professional, are clearly stated in these Terms.

Scope
These Terms govern the sale of products available on the MXHOME Website on the day the order is placed by the Customer (hereinafter referred to as the "Products"). They apply to all order placement methods offered by MXHOME, whether the order was placed on the MXHOME Website, by email, or by phone.

The latest revision of these Terms was made on 10/22/2022. These Terms may be modified at any time by MXHOME. The Terms applicable to the order placed by the Customer are those in effect on the date the order is recorded.

Order process
Any Customer of the company MXHOME declares having the capacity to contract under the conditions described below, that is to say, being an emancipated minor or of legal age and not being under protection as defined in Article 425 of the Civil Code. 

MXHOME reserves the right to refuse any order or order in process from a Customer with whom it is in dispute, particularly a payment dispute.

Acceptance of the Terms by the Customer
These Terms are accessible on the MXHOME Website. Upon simple request from the Customer, they can also be sent by email. In the case of a purchase made online on the site m-x-home.com, the customer automatically accepts the general terms and conditions of sale through it, without restriction or reservation of these Terms.

Product Features
MXHOME presents, on the Product datasheets, the essential characteristics of the products that the Customer must be aware of. MXHOME reserves the right to modify the Product assortment, notably based on constraints related to its raw material suppliers. MXHOME will make its best efforts to ensure that the photographic representation of the Products on the MXHOME Site is as accurate as possible. However, it is possible that the perception of the Product(s) does not fully correspond to the Product(s). The Product(s) are sometimes shown in photographs together with other Product(s).

Except where otherwise specified on the MXHOME Site, all Products sold by MXHOME are new. In any case, the Products comply with the current European Union legislation and the applicable standards in France.

Product Availability
We do our best to keep all items in stock. However, some items sell faster than expected and may experience production delays. If an item is out of stock, we will inform you. Otherwise, you will be delivered within 6 to 15 business days.
When the Product is not in stock at MXHOME, MXHOME will inform the Customer of any possible delivery delay compared to the timeframe mentioned on the Site, by email. Since this timeframe is a guarantee from MXHOME, the Customer will have the right to request the cancellation of their order and request a refund. The refund will be processed as soon as possible and no later than within 14 days in accordance with regulations.  

Order Confirmation
The order date between MXHOME and the Customer is deemed to be the date of the order confirmation email for the Products. Indeed, an email is automatically sent to the Customer to confirm the order placement, provided that the email address entered in the registration form is correct. MXHOME does not send order confirmations by postal mail or fax. However, the contract will only be final upon MXHOME’s receipt of the Customer’s payment for the order in accordance with article 4.4.2 below (hereinafter the "Order Date"). Nevertheless, this Order Date is subject to conditions related to the anti-fraud checks implemented by MXHOME. If additional administrative documents are requested to verify the identity of the person placing the order (see paragraph 4.6 "Checks to prevent fraud" below). In this case, the Order Date will be the later of the two dates between the receipt of the Customer’s payment and the receipt of the requested documents. The timeframes indicated on the MXHOME Site only begin from this Order Date as described above.

Retention of title
MXHOME remains the owner of the Products delivered until full payment is made by the Customer. The above provisions do not prevent, from the delivery of the Products, the transfer to the Customer of the risks of loss or damage to the Products subject to retention of title, as well as any damage they may cause. 

Payment methods 
The customer can pay for their order: Online on the MXHOME Website by credit card (Carte Bleue, Visa, Eurocard, Mastercard). Paypal, Apple Pay. In this case, the Customer's account will be debited for the amount of their purchases at the time of payment validation; The Customer guarantees MXHOME that they have any necessary authorizations to use the chosen payment method. MXHOME reserves the right to suspend any order processing and delivery in case of refusal of payment authorization by officially accredited card organizations or in case of non-payment.

The company MXHOME has implemented an order verification procedure to ensure that no one uses another person's banking details without their knowledge. However, the consumer is informed that MXHOME cannot be held responsible for any wrongdoing or fraudulent use of any payment method that has not been detected by the verification procedure. As part of this verification and in accordance with article 4.6 below, the Client may be asked to send by email to MXHOME a copy of an identity document as well as proof of address. The order will only be validated after receipt and verification of the documents sent by our services. If these documents are not received within 14 days following the order placement, the order will be deemed automatically canceled. MXHOME retains full ownership of the Products sold until full payment of all amounts due by the consumer in connection with their order, including fees and taxes.

Controls to prevent any fraud
In order to prevent fraudulent use of payment methods, Customer accounts, delivery addresses, and to further secure Customer transactions, MXHOME conducts checks on orders placed by its Customers. As part of these checks, the Customer may be asked to provide administrative documents such as: proof of identity and/or proof of address (landline phone bill, electricity, gas, water bill, etc.), and for companies: a KBIS extract less than 3 months old. As part of these checks, if the supporting documents are not provided or if the documents submitted do not allow us to establish with certainty the identity of the person placing the order and the validity of the address, we will not be able to validate the order and it will then be canceled. Refunds corresponding to these orders cannot be processed without a number of necessary verifications to identify the payer of the order. Thus, a payment made by credit card will be refunded only and directly to the Customer's credit card account.

Invoice
The order form that the Customer completes online or the order confirmation sent by email to the Customer by MXHOME does not serve as an invoice. Regardless of the ordering and payment method used, the Customer must request the invoice from MXHOME by email. MXHOME keeps an electronic copy of each invoice, and the Customer can request it again at any time.  

Payment delays

In the event of a refusal by the bank for a credit card debit or other payment method, it is the Customer's responsibility to contact customer service to settle their order by any payment method.

Information provided at the time of order
The Customer is responsible for the accuracy and completeness of the information in their Customer account and their order to ensure proper processing. In particular, the Customer's address and the delivery address of the order are entirely their responsibility. MXHOME cannot guarantee the consequences or be held responsible for additional delivery delays or additional delivery costs caused by an error in the information provided by the Customer. Any costs incurred by MXHOME as a result of errors in the information provided by the Customer will be borne by the Customer, especially the costs of reshipping the order.

Price
Product prices are indicated in euros, including all taxes and excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in the product prices after the effective date of the new applicable rate. The VAT rate applied is a percentage of the value of the goods sold and depends on the type of equipment purchased. Eco-contribution fees are clearly and distinctly indicated in accordance with current legislation in the product sheets and in the order summary. These eco-contributions are subject to the VAT applicable on the day of the order.

The prices of MXHOME's raw material suppliers are constantly changing, so the prices displayed on the sites may be modified at any time. They may also vary due to launch prices, promotions, or sales.

In any case, the applicable price is the one indicated on the MXHOME Site on the date the order is recorded by the Customer.

Discounts and Gifts
Only one individual discount (for example, in the form of a promo code) can be applied per order. When purchasing a Product in multiple quantities, the discount applies only to the first item, unless otherwise stated in the notice sent with the promotion or discount code.

Packaging
The Products are packaged in accordance with current transportation standards to ensure optimal protection of the Products during delivery. The Customer is required to comply with these same standards when returning a Product, whether for after-sales service or for a return for convenience. Any damage observed on a Product upon return due to non-compliance with packaging standards may result in a partial refund or no refund of the Product if resale in its current condition is impossible or if the indicated technical issue has worsened.

Order Tracking
The Customer can at any time check the status of their order using the tracking number sent by email.

The Customer can contact MXHOME customer service at any time to be informed about the status of their order.

Taxes and customs clearance:
Deliveries outside Europe and Switzerland are subject to customs duties and/or taxes.

If you order from outside Europe, taxes and customs fees will be automatically calculated at checkout to ensure fast and hassle-free delivery.

The invoice accompanies the package and a copy is sent to the Customer at the billing address.

Delivery of Foam Beds and Sofas

Free shipping in France only.
Please inform us of any specific access issues (narrow street, upper floor access, pedestrian street, etc.) when placing your order for heavy and/or bulky products. 

If you do not have an elevator or an indoor staircase suitable for transporting the bulky Product, the delivery person will be free to deliver the bulky Product to the ground floor of the delivery location. 
If the delivery location of the bulky Product is not easily accessible for the delivery person, so that the delivery person is forced to offer a second delivery or a delivery to a more accessible location, this second delivery will be charged to you. 

Damaged packages
The Customer must check the condition of the package in the presence of the carrier and make any necessary reservations on the delivery note in case of apparent anomalies (partial or total damage to the package, damage, missing product compared to the delivery note, damaged package, broken products, etc.). The Customer or their representative must explicitly state PRECISE RESERVATIONS on the delivery note: indication of the number of missing and/or damaged packages and a detailed description of any damage (opened or torn packaging, damaged or missing product, etc.). Vague statements such as "subject to unpacking" or "subject to verification" are invalid. In the absence of any reservation, the goods are deemed accepted by the Customer and cannot be contested regarding their delivery.

If the Customer raises any reservations, they must confirm them by registered letter with acknowledgment of receipt sent to the carrier within 3 days, excluding public holidays, following the day of delivery. They must also notify MXHOME customer service within the same period, by email to contact-pro@m-x-home.com so that MXHOME can take the necessary steps to arrange for the return of the Product and a new delivery as soon as possible. If no notification is given, MXHOME cannot be held responsible for any delay in handling the new delivery.

If a shipped package arrives open or damaged, the Customer must have the delivery person issue a "report of spoliation" (report 170) so that MXHOME can initiate an investigation and compensation procedure.

Responsibility
1 Force Majeure: In the event of a force majeure event, defined by Article 1218 of the Civil Code as an event beyond the debtor's control, which could not have been reasonably foreseen at the time of the contract's conclusion and whose effects cannot be avoided by appropriate measures, preventing the debtor from fulfilling their obligation (such as a fire, war, strike, natural disaster...), which includes, in particular, for the purposes of these Terms, a carrier strike slowing down or preventing the delivery of parcels (hereinafter referred to as "Force Majeure"), MXHOME will use all means at its disposal to inform the Customer of the status of the shipment of their parcel. However, in the event of Force Majeure, MXHOME cannot under any circumstances be held responsible for delays and delivery issues caused.

Product Usage
MXHOME declines all responsibility for any misuse or improper use of the Products ordered by the Customer. 

8.3 Information Presented on Sites Other Than the MXHOME Site
MXHOME cannot be held responsible for information published on sites other than the MXHOME Site. Links to third-party sites are provided for convenience only and do not imply any endorsement of their content.

Tax
For all Products that the Customer intends to ship outside the European Union and Overseas Departments and Territories, obtaining an export sales slip from our services will allow them to initiate the necessary procedures to obtain a refund of the VAT rate on the Product or the corresponding order. If the Customer meets all the conditions required by customs, they must request the export sales slip by email from our services and include a double-sided copy of an identity document (passport, identity card, consulate registration card, etc.). In the case of relocating an order or a Product to a country other than mainland France, we remind you that you remain the importer of the Product(s) concerned. Any customs duties, other local taxes, import duties, or state taxes that may be payable are not the responsibility of MXHOME. It is entirely your responsibility to inquire with local authorities and to assume the burden of declarations and payments to the competent authorities and organizations of the country concerned.

MXHOME's liability cannot be engaged in the event of non-compliance with the legislation of the country where the Products will be shipped by the consumer. It is the consumer's responsibility to check with local authorities the possibilities of importing or using the Products or services they intend to ship, and to ensure that their technical and operational specifications specific to the manufacturer comply with the legislation of the country concerned.

Entirety of the Terms
If any provision of these Terms is declared invalid or unenforceable, the validity and enforceability of the remaining provisions of these Terms shall in no way be affected. Such invalid or unenforceable provision shall be replaced by a valid or enforceable provision that most closely approximates the intended effect of the invalid or unenforceable provision.

Jurisdiction and applicable law
These Terms are governed by French law. In the event of a dispute between the parties and following an unsuccessful written complaint by the Customer to MXHOME's customer service or in the absence of a response from this service within a reasonable period of one (1) month, the Customer may use any alternative dispute resolution method, including mediation, by contacting the following mediator(s): [contact details of the mediator(s) and their website(s)] or by accessing the European online dispute resolution platform at the following address: http://ec.europa.eu/odr who will attempt an amicable resolution. If the dispute cannot be resolved through this mediation, it will be brought before the competent French courts of Draguignan.

MXHOME gives your furniture a new life.

We have a simple and eco-friendly solution to offer you. When purchasing a new MXHOME product, you can entrust us with your old MXHOME furniture under the following conditions:

- The customer must first contact MX HOME customer service once their order has been placed to indicate their intention to return old equipment.

This request will be subject to acceptance by MXHOME

- The item returned must be equivalent to the one purchased (an XL pouf for an XL pouf, a cushion for a cushion)

In all cases, the potential return of your equivalent furniture as well as its constraints must be indicated before the purchase agreement.
