General Terms and Conditions of Sale (GTC) — MX HOME
These general terms and conditions of sale (hereinafter the "GTC") are concluded between:
MX HOME, a company with capital of €1,000, registered with the Fréjus Trade and Companies Register under number 918 620 477, intra-Community VAT FR69918620477, whose registered office is located at 980 avenue du peyrat, 83310 Grimaud, France (hereinafter "MX HOME", "we" or "our"),
and any adult natural person acting as a consumer (hereinafter the "Customer" or "you"), wishing to make a purchase via the online sales site m-x-home.com (hereinafter the "Site").
1. Subject
The General Terms and Conditions of Sale define the conditions applicable to the sale of products by MX HOME on the Site, from ordering to payment, including delivery and after-sales service.
2. Scope
The General Terms and Conditions of Sale apply to all orders for products available on the Site on the date the order is placed. They apply regardless of the ordering method offered by MX HOME (Site, email or telephone, when such a method is accepted by MX HOME).
The General Terms and Conditions may be amended at any time. The applicable General Terms and Conditions are those in force on the date the order is registered.
3. Capacity
The Customer declares that they have the legal capacity to enter into a contract, meaning that they are of legal age and are not under protection within the meaning of Article 425 of the Civil Code.
4. Products
The essential characteristics of the products are presented on their product pages. MX HOME reserves the right to modify the product range, particularly depending on supplier-related constraints.
MX HOME makes every effort to ensure that the photographic representation of the products is as accurate as possible. However, variations may exist (particularly depending on screens, batches, and materials). The visuals are non-contractual.
5. Availability
We do our best to keep items in stock. Some items may sell faster than expected and be subject to production delays. In the event of unavailability or a significant delay, we will inform you.
6. Ordering process
The Customer selects the products, confirms their basket, enters the necessary information (in particular delivery/billing details), and proceeds to payment.
MX HOME reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, in particular a payment dispute, or in the event of suspected fraud.
7. Order confirmation and validation
An order confirmation email is sent to the Customer at the address provided when placing the order, subject to there being no input errors. The contract becomes final upon receipt of payment and, where applicable, completion of the anti-fraud checks.
8. Price
The prices are indicated in euros, all taxes included (TTC), excluding delivery charges where applicable. The applicable price is the one displayed on the Site at the time the order is registered.
Promotional offers or discount codes may be offered. Unless otherwise stated, only one individual discount may be applied per order.
9. Payment
The payment is made online via secure providers. Payment methods offered (subject to availability): Shopify Payments (credit cards), PayPal et Alma.
MX HOME reserves the right to suspend order processing and delivery in the event of refusal of authorisation by the payment institutions or in the event of non-payment.
10. Anti-fraud checks
To prevent fraudulent use, MX HOME may carry out checks on certain orders. In this context, you may be asked to provide supporting documents (e.g. proof of identity, proof of address, etc.). If the requested documents are not provided within a reasonable time, the order may be cancelled and refunded using the payment method used.
11. Retention of title
MX HOME remains the owner of the products until full payment of the price. The transfer of risk (loss, damage) occurs when the Customer (or a third party designated by them) takes physical possession of the products.
12. Invoice
The order confirmation does not constitute an invoice. Upon request, an invoice can be sent by email. Contact: commercial@m-x-home.com.
13. Information provided by the Customer
The Customer is responsible for the accuracy of the information provided (in particular the delivery address, email, and telephone number). MX HOME cannot be held liable for delays or additional costs resulting from an input error. In the event of a parcel return due to an address error or absence, the reshipping costs may remain the Customer’s responsibility.
14. Delivery
The preparation times are generally 4 to 8 business days (excluding exceptional periods). Delivery times and charges vary depending on the area and the nature of the order. Detailed terms are set out on the page Delivery Policy.
15. Bulky deliveries — "to the doorstep"
For bulky orders (particularly sofas, beds, or orders of more than four (4) items), delivery may be handled by specialist carriers (e.g. Geodis, Kuehne+Nagel) and takes place only at the foot of a building or house (so-called "doorstep delivery"), without unpacking, without pallet removal, without carrying upstairs.
The Customer must provide the means necessary to transport the parcels to the final place of use. In the event that the delivery location is inaccessible, resulting in a second delivery attempt, this may be invoiced.
16. Receipt — damaged / missing package
The Customer must check the condition of the packages upon delivery. In the event of any visible anomaly (damaged, opened, or missing package), the Customer must make precise reservations upon receipt from the carrier (or refuse the parcel if necessary), take photos, and contact MX HOME as soon as possible: commercial@m-x-home.com.
17. Right of withdrawal (consumers)
Conforming to the Consumer Code, the Customer has a period of 14 days from receipt of the goods to notify their decision to withdraw, without having to give any reason.
The Customer may exercise their right using the standard form available on our page Returns / withdrawal policy or by any unambiguous statement sent to the address commercial@m-x-home.com.
18. Returns and refunds
The return conditions (return address, expected condition of the products, time limits, fees) are detailed on the page Returns / withdrawal policy.
The refund will be made no later than 14 days from the date on which we are informed of the decision to withdraw. For sales of goods, the refund may be deferred until the goods are recovered or until proof of shipment is received, whichever comes first.
19. Exceptions to the right of withdrawal
The right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised, as well as to other exceptions provided for by law. Custom requests are not sold online and are subject to a separate exchange.
20. Legal guarantees
The Customer benefits from the legal warranties in force (legal warranty of conformity and warranty against hidden defects). For any request: commercial@m-x-home.com.

22. Liability — force majeure
MX HOME shall not be held liable in the event of non-performance or delay due to force majeure within the meaning of Article 1218 of the Civil Code, or due to an unforeseeable and insurmountable act of a third party.
23. Taxes and customs
For deliveries outside the European Union, customs duties and local taxes may be payable. The Customer is invited to enquire with the competent authorities in the destination country. For all international enquiries: contact@m-x-home.com.
24. Governing law and competent jurisdiction
The present General Terms and Conditions of Sale are governed by French law. Failing an amicable resolution (including mediation), the dispute shall be brought before the competent French courts.
