General Terms and Conditions of Sale (GTCS) — MX HOME

These general terms and conditions of sale (hereinafter the “GTCS”) are entered into between:

MX HOME, a company with share capital of €1,000, registered with the Fréjus Trade and Companies Register under number 918 620 477, intra-community VAT FR69918620477, whose registered office is located at 413 avenue de l'Héliport, 83310 Grimaud, France (hereinafter “MX HOME”, “we”, or “our”),

and any adult natural person acting as a consumer (hereinafter the “Customer” or “you”), wishing to make a purchase via the online sales website m-x-home.com (hereinafter the “Site”).


1. Purpose

The GTCS define the conditions applicable to the sale of products carried out by MX HOME on the Site, from ordering to payment, including delivery and after-sales service.

2. Scope

The GTCS apply to all orders for products available on the Site on the day the order is placed. They apply regardless of the order method offered by MX HOME (Site, email, or telephone, when such a method is accepted by MX HOME).

The GTCS may be amended at any time. The applicable GTCS are those in force on the date the order is recorded.

3. Capacity

The Customer declares that they have the legal capacity to enter into a contract, that is to say, that they are of legal age and are not subject to any legal protection measure preventing them from contracting.

4. Products

The essential characteristics of the products are presented on their product pages. MX HOME reserves the right to modify the product assortment, particularly according to constraints related to suppliers, stock, or production.

MX HOME makes every effort to ensure that the photographic representation of the products is as faithful as possible. However, variations may exist, particularly depending on screens, production runs, materials, fabric dye lots, or shooting conditions. Visuals are non-contractual.

5. Availability

We do our best to keep items in stock. Some items may sell faster than expected or be subject to restocking, manufacturing, or production lead times. In the event of unavailability or a significant delay, MX HOME will inform the Customer as soon as possible.

6. Order process

The Customer selects the products, confirms their basket, provides the necessary information, in particular delivery and billing information, and then proceeds to payment.

MX HOME reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, in particular a payment dispute, or in the event of suspected fraud.

7. Order confirmation and validation

A confirmation email is sent to the Customer at the address provided when placing the order, subject to there being no input error. The contract becomes final upon receipt of payment and, where applicable, completion of anti-fraud checks.

8. Prices

Prices are indicated in euros, all taxes included (TTC), excluding delivery charges where applicable. The applicable price is the one displayed on the Site at the time the order is recorded.

Promotional offers or discount codes may be offered. Unless stated otherwise, only one individual discount may be applied per order.

9. Payment

Payment is made online via secure service providers. The payment methods offered may include, subject to availability: Shopify Payments (bank cards), PayPal and Alma.

MX HOME reserves the right to suspend order processing and delivery in the event of refusal of authorisation by payment organisations or in the event of non-payment.

10. Anti-fraud checks

In order to prevent fraudulent use, MX HOME may carry out checks on certain orders. In this context, the Customer may be asked to provide supporting documents, such as proof of identity or proof of address. Failing receipt of the requested documents within a reasonable period, the order may be cancelled and refunded using the payment method used.

11. Retention of title

MX HOME retains ownership of the products until full payment of the price. The transfer of risk, in particular the risk of loss or damage, takes place when the Customer, or a third party designated by them, takes physical possession of the products.

12. Invoice

The order confirmation does not constitute an invoice. Upon request, an invoice may be sent by email. Contact: commercial@m-x-home.com.

13. Information provided by the Customer

The Customer is responsible for the accuracy of the information provided, in particular the delivery address, email address, and telephone number. MX HOME cannot be held liable for delays, delivery errors, or additional costs resulting from incomplete or incorrect information. In the event of a parcel being returned due to an address error, absence, or inability to deliver attributable to the Customer, reshipping costs may remain payable by the Customer.

14. Delivery

Preparation times, transit times, delivery charges, delivery areas, and the terms applicable to standard or bulky orders are detailed in our Shipping Policy.

The Customer is invited to consult this page before placing any order. The stated times are estimates only and may vary depending on product availability, the delivery area, the time of year, or constraints specific to carriers.

15. Bulky orders

Certain orders, due to their volume, weight, or composition, may be subject to specific delivery terms. These conditions are specified in our Shipping Policy.

The Customer must ensure that the delivery location is accessible and that the necessary means are in place to receive the products, particularly when delivery is made to the doorstep.

16. Receipt of the order

Upon receipt, the Customer must check the apparent condition of the parcels and products. In the event of an apparent anomaly, in particular a damaged, opened, missing parcel, or a damaged product, the Customer must follow the instructions specified in our Shipping Policy and contact MX HOME as soon as possible at the following address: commercial@m-x-home.com.

17. Right of withdrawal

In accordance with the Consumer Code, the consumer Customer has a period of 14 days from receipt of the goods to notify their decision to withdraw, without having to give any reason.

The Customer may exercise their right of withdrawal via our dedicated page EU Withdrawal, or by any unambiguous statement sent to commercial@m-x-home.com.

18. Returns and refunds

The return conditions, in particular the return address, the expected condition of the products, time limits, any fees, and refund procedures, are detailed in our Returns and Refunds Policy.

The refund will be made no later than 14 days following the date on which MX HOME is informed of the decision to withdraw. For the sale of goods, the refund may be deferred until the goods have been recovered or until proof of shipment has been received, whichever occurs first.

19. Exceptions to the right of withdrawal

The right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised, as well as to other exceptions provided for by law. Custom-made requests are not sold online and are handled through a specific exchange.

20. Statutory warranties

The Customer benefits from the statutory warranties in force, in particular the legal guarantee of conformity and the warranty against hidden defects. For any request, the Customer may contact MX HOME at the following address: commercial@m-x-home.com.

21. Personal data and cookies

The processing of personal data and the use of cookies or trackers are described in our Privacy Policy and, where applicable, in our Cookie Policy.

22. Liability — force majeure

MX HOME cannot be held liable in the event of non-performance or delay due to a case of force majeure within the meaning of article 1218 of the Civil Code, or due to an unforeseeable and insurmountable act of a third party.

23. Taxes and customs

For deliveries outside the European Union, customs duties, local taxes, or import charges may be payable. Where applicable, these charges are borne by the Customer. The Customer is invited to inquire with the competent authorities of the destination country before placing any order. For any international request: contact@m-x-home.com.

24. Consumer mediation

After a prior written approach to our customer service department that remains unresolved, the consumer Customer may use a consumer mediator free of charge with a view to the amicable resolution of a dispute.

25. Applicable law and competent jurisdiction

These GTCS are governed by French law. Failing an amicable resolution, in particular through mediation, the dispute will be brought before the competent French courts.
